Injuries From Trucking Accidents On The Rise As Lawmakers Try To Increase Weight Limit

Truck CrashLawmakers across the United States have recently put forth new legislation in an attempt to increase the weight limit of trucks on the road. It is expected that more people may become injured on the road as a result of heavy trucks being on the road. For those who have already been injured in trucking accidents, it is important to get in touch with a personal injury lawyer who can assist with the case.

Specifically, Ohio legislators have attempted to create new legislation that would allow a 90,000 pound truck to be driven on the highways of the state. It is expected that the bill will likely pass in the Senate. The bill has already been passed by the House of Representatives.(See "Truck Loads Weighing 90K Debated" from Dayton Daily News)

Those who oppose this legislation have stated that the legislation would cause a significant increase in the budget funds that must be used for this project. It is expected that allowing a weight increase would cost at least $40 million... ...read full post

NTSB Wants To Lower The Blood Alcohol Limit For Driving

Sobriety CheckMothers Against Drunk Driving has been successful over the past 20 years in getting the legal blood alcohol content driving limit reduced in all states to .08, but now the National Transportation Safety Board has issued a recommendation to all states to reduce that threshold even further to .05. The NTSB cited that all other countries in the industrialized world use the .05 impairment standard and the United States should follow suit.

The MADD association spent an extensive amount of time and financial resources lobbying to achieve the standard for drunk driving laws reduced to the current level. Although the NTSB has just released this recommendation, MADD has not been eager to sign on just yet. The lobbying association still depends on donations from within each state for continuing funding and feel they have been relatively successful already, especially with recent seat belt legislation being upgraded to a primary offense in most states.

The NTSB has little regard for any professional commercial organizations that will provide... ...read full post

Personal injury protection laws vary significantly across the nation, and understanding these laws can be difficult. However, those who live in Florida want to take note of the recent change. Why Was The Law Changed?

PIP court cases often last for lengthy periods of time, and the cost of fighting against a claim is expensive for companies. As a result, companies regularly lobby to place limits on PIP laws. Speedy Drivers Slow Down - The 3 Minutes You Gain By Driving Dangerously Are Not Worth Someones Life

No one likes to wait. No one wants to be late for work or an appointment.

But speeding, running lights and driving recklessly not only put others and your self at risk, they at best may save a few minutes from a trip.

On my way into the office today I was stopped at an intersection next to a school bus stop with no less than 14 middle school kids waiting for the bus. I briefly looked right then left, and my lanes we clear, taking my foot off the brake I looked up again and to my surprise a driver who apparently just cant' handle the speed limit was passing another driver directly in front of the middle school kids!

No regard to 14 kids waiting unprotected at a bus stop. Had I not paused for a moment or not checked BOTH directions I would turned onto the road and directly into a head on collision with a full sized SUV a few feet next to a bus stop full of children. No... ...read full post

Trucking Industry Squashes Safety Concerns With Push For Heavier Loads

Heavy Semi Truck Unsafe LoadSeveral efforts are underway by the trucking industry to get the weight limit of commercial trucks raised from the current limit of 80,000 pounds up to 20% higher at 100,000 lbs.

Proponents of raising the weight limits claim increasing the loads will result in fewer trips and truckers choosing to use major interstates rather than secondary roadways. Endorsers of heavier trucking weight limits also claim raising the maximum weight would also result in less fuel consumption due to fewer trips.

In fact a pilot program has already been under way in Maine and Vermont that allowed truckers to carry as much as 100,000 pounds per load. Members of congress supported by the trucking lobby are actively trying to attach new legislation allowing for an increase in weight up to 97,000 pounds for heavy trucks.

This effort to raise the weight limit is motivated by Wall Street and trucking company CEOs, and is a direct threat to the safety of drivers who must share the roadways with heavy trucks. In fact on of the... ...read full post

TSA Allows Knives Back Onto Flights - Bad Idea

Being an attorney who is on the Advisory Board of two Sheriff’s Offices and the Florida Highway Patrol, the idea of letting small knives, which are in fact deadly weapons on an airplane, is very poorly thought through.

A person need only talk to any practicing surgeon to realize a knife, known as a scalpel, with a blade of ½” or less can cause severe damage in the wrong hands.

Flight attendants are not trained in the art of self defense of an assailant wielding a knife. Unfortunately with our budget limitation, we cannot have an air marshal carrying a firearm on every flight.
I truly believe if a passenger uses a knife during flight to inflict damage on a fellow passenger or airplane personnel, that TSA and the Federal Government have an exposure to civil litigation for damages.

The idea of a passenger drinking heavily before a flight and during a flight while carrying a concealed weapon (knife) should be a concern to everyone who does airplane travel.... ...read full post

Car Accident Attorneys Get You Fair Settlement

Automobile accidents are never fun and recovering can be a long process for many victims of negligent driving. Even minor accidents can result in injuries that may last a lifetime, so it is important for anyone involved in an automobile accident to consider the legal aspects of the accident. Insurance companies often want to settle cases quickly when long-term injury liability commitments are apparently enforceable. Car accident attorneys understand this situation and know how to maximize any personal injury claim that may have long-term physical damage.

Some personal injury claims are relatively simple. The injury will eventually heal over a reasonable period of time. However, some injuries are complicated and the effects last an entire lifetime. Calculating and anticipating how an injury will progress is not an exact process, but there are general guidelines for both compensatory and punitive damages. This is never a process for the victim to attempt without professional legal counsel, as insurance companies will work at deflecting any consideration of retaining a car crash lawyer. If the insurance company says that car accident attorneys are not necessary, then rest assured they are.

It is important for personal injury claimants to understand the difference between compensatory... ...read full post

The Daytona Speedway Crash Highlights The Extreme Forces At Work During A Car Accident

High Speed Crash Causes Serious InjuriesThe recent high-speed crash-up at Daytona speed way illustrates the violent forces at work during a car crash in spectacular fashion. Perhaps a little too spectacular for the fans seated close to the action as fragments of the cars were hurled through the barrier protecting the fans. When a massive object like an engine block gets moving at high speed the amount of potential energy is increased exponentially. Anyone getting impacted by flying debris would be in serious trouble. The forces withing the car are just as powerful. When a car suddenly stops or changes directions the drivers and passengers are subjected to extreme G forces. If not properly secured and protected the G forces at work on a drive while a car is slammed into a wall can break bones, cause damage to the brain as the brain is pressed against the inside of the skull and even damage soft tissues within the body.

Experienced Personal Injury Attorneys Stay Current With State Laws

Experienced personal injury lawyers understand the importance of staying current with state laws. Not only do they watch for last minute changes in state laws, these top notch attorneys know what future changes are in the process of becoming new laws. This gives them an advantage in preparing a complicated case, and knowing what new laws may come into effect could influence how the case progresses.

State Personal Injury Laws Differ
Finding the right personal injury lawyer is extremely important to anyone who has been injured, discriminated against, or otherwise has incurred personal harm. Survivors of a deceased loved one may be able to obtain compensation by making wrongful death or other personal injury claims. Again, each state has its own set of laws that apply to personal injury lawsuits; what works in one state may not be used in another. This reinforces the need to find an injury attorney who is current with state laws in the jurisdiction of your case.

Meeting Challenges with Knowledge

Car Accident Attorneys Use Tort Law To Protect Your Rights

Car accidents occur frequently because of the many automobiles on the road. An automobile accident can cause financial devastation, physical injuries and even death. Experienced car accident attorneys use the law to ensure that victims of car accidents get the monetary compensation that they deserve.

After a car accident, insurance companies do not always act in good faith. Even when the injuries and property damage caused by a car crash are severe, insurance companies often offer small amounts of money to settle the case. A good car crash lawyer will carefully evaluate all settlement offers and advise the victim of a car accident whether the amount offered by an insurance company is sufficient. The lawyer can also negotiate with the insurance companies to try to obtain a fair settlement.

If an insurance company does not offer enough monetary compensation to the victim of a car crash, the next step is for a car accident attorney to file a lawsuit against the individual who caused the accident. Lawyers must file personal injury lawsuits within a certain period of time, which is called the Statute of Limitations. If the... ...read full post

Drivers Watch Out: Distracted Pedestrians Can Get You Sued

Distracted Pedestrians Can Get You SuedOn my way to the law office in Sarasota today I was sitting traffic near an elementary school. With six lanes of traffic stopped a red light, I saw a young lady intently focused on her iPhone making her way between, the stopped cars to cross the street.

Just as the light turned green and drivers began to take their foot off their brake pedals two small children only visible by the tops of their heads just above the hood of the adjacent car followed the young lady.

This woman was still completely focused on her iPhone unaware her small children were suddenly in great danger. Fortunately by some stroke of luck the other drivers spotted the kids and they made it across Fruitville safely. This was nearly a tragedy that could have ended the lives of two young kids, a wrongful death law suit and many lives ruined, because a pedestrian was more worried about answering tweets or emails than paying attention to their situation and their children. For The Injured - Car Accident Attorneys Are More Important Than Ever

The old way of thinking when it comes to injuries sustained in a car crash was to seek out a general lawyer and allow the insurance company to make an offer which typically seemed rather fair. Times have changed and the continual shuffling and rewording of statutes relevant to such accidents and associated injuries has made the need for a car accident attorney even more important. This is because an attorney who specializes in representing auto accident victims, can help a victim get the best case outcome as these specialized lawyers have the expertise in all aspects of injury law and also have the most relevant, pertinent and up to date information as it will relate to the case.

One good example is the state of Florida where recent PIP law legislation has made such injury cases more favorable to insurance companies instead of the actual victims who sustained injuries. It are these skilled and specialized car crash lawyer firms that are best equipped and educated in all aspects of case... ...read full post

Buckle Up: Even Without Snow Storms Florida Gets It's Share Of Winter Car Crashes

Snowbirds arrive on the roads in SarasotaWhile the Northeast toughs it out through the hazardous driving conditions from a major winter storm, we Floridians are basking in the sun.

New PIP Law Gouges Benefits For Accident Injuries And Lets Insurance Companies Off The Hook.

It looks like the Florida insurance industry will be having a great year. To bad the boost in profits may come off the backs of those injured in car crashes and auto accidents.

In 2012 the Florida legislature voted to approve new laws aimed at reducing insurance fraud in the state.  Auto insurance fraud is a real problem in Florida however the trouble is, the sweeping new PIP changes basically address the problems by reducing benefits for everyone.

The new law will have the practical effect of making the law-abiding vast majority of the insurance industries customers pay for the crimes of a very small percentage.

The particular part of insurance under the scalpel is PIP (personal injury protection). Under the old law,  PIP rules required the insurance policy that says drivers are required to carry at least $10,000 of coverage for injuries that result from accidents even if the accident is the driver's fault.

Well with the new that PIP coverages have been gutted a now a paltry $2,500 of coverage is all that is required. If you have been seriously injured and require any amount of emergency room medical care $2,500 will hardly be enough.

For instance if, doctors feel you need... ...read full post

Night Club Owners Beware: Your Patron's Safety Is Your Responsibility

Nightclub fires are a tragic example of  how bad decisions combined with bad luck end with fatal consequences. It's easy for a bystander to think, sometimes bad luck strikes and  these things just happen, but the reality is that this and may other notable fires could have been prevented – and that ultimately there is a responsible party. In the Brazilian fire, like the Station Night Club fire in Rhode Island USA, the highly flammable acoustic foam was ignited by pyrotechnics used during a performance. Whether use of the fireworks was sanctioned by the club owner or initiated by the band without the club owner's knowledge may or may not have an affect on who is ultimately found liable for the disaster. Insurance Companies Stacked The Deck Against Florida Accident Victims.

Insurance Company Don't Play Fair - Hire a lawyerThat's a strong statement but thanks to the lobbying efforts by the insurance industry, the Florida legislature has become increasingly hostile to claimants and more friendly towards insurance providers.

One measure in particular, Florida statute 627.4136, known as the non-joinder statue has had a negative impact for those injured in auto accidents that have filed suite to pursue fair compensation.

In a nutshell, the non-joinder statute basically hides the insurance company's name and involvement during the trial. In other words members of the jury will be kept from any knowledge of the at-fault driver's insurance situation.

Well, so what? What does that matter if the jury is unaware that the driver that caused the injuries has any insurance? Turns out it matters a great deal. Especially if your the one who has been injured.

If a jury has been given the task of awarding compensation for life-altering injuries and they have been given the impression the defendant has no insurance, the jury will certainly award a much smaller... ...read full post

So You Have Won Your Injury Settlement - Will The IRS Tax Your Award?

As the year draws to a close, with the Fiscal Cliff hanging over all of our collective heads, those who also have had the misfortune to sustain a personal injury accident may also be trying to accomplish some year-end tax planning.

With that in mind, the question may now be arising of, “Will my personal injury settlement be counted as income to me on my 2012 Federal Income Tax Return?”  Excellent question!

The answer is probably not.  As a general rule, most personal injury settlements are for what are known as compensatory damages; ie. Compensating you for your pain and suffering.  In those cases, the money (compensation) that you receive, is not taxable.  The specific IRS Code section which is applicable is IRC § 104(a)(2).

However, if you receive a special type of damages, called punitive damages, those damages are taxable as income.  Punitive damages are the type of damages which are intended to punish the person or entity which caused you harm.  The United States Tax Court in Bagley v. Commissioner, 105 T.C. No. 27 (1995)... ...read full post
